TERMS OF USE, SERVICE AND PRIVACY POLICY – THE CLASSIC GAMES
By accessing, creating an account, or playing on The Classic Games server, you confirm that you have read, understood, and fully agree to the following Terms of Use and Service, as well as our Privacy Policy. Acceptance of these Terms is a mandatory condition for accessing and remaining in the game. If you do not agree with any part of these Terms, you must immediately cease using the Server.
1. DEFINITIONS
For the purposes of this agreement, the following definitions apply:
Server / Game: The private online gaming virtual environment provided by The Classic Games.
User: The individual who creates an account and accesses the Server.
User Account: The individual access vehicle created by the User to enter the game.
Virtual Items / Game Currency: Digital goods, currencies, equipment, and characters obtained within the game, whether through gameplay time, events, or purchases/donations.
2. OBJECT AND BINDING
2.1. These Terms govern the relationship between you and the administration of The Classic Games. By using the Server, you acknowledge that the Official Game Rules, available on our official channels, are an integral and inseparable part of this document. Failure to comply with any rule constitutes a direct violation of these Terms.
2.2. Access to the Server is granted as a limited, non-exclusive, personal, and revocable license. The Administration reserves the right to revoke this license and terminate your access at any time, for any reason, at its sole discretion.
3. ACCESS REQUIREMENTS AND AGE RATING
3.1. To create a User Account, you must provide accurate and truthful information. Providing false data may result in account blocking.
3.2. The User must verify that they have the necessary hardware and internet connection requirements to access and use the Game.
3.3. Age Rating (Majority): The Server and the games available on it are intended exclusively for individuals over 18 (eighteen) years old. By creating a User Account, accessing the game, and accepting these Terms, you declare and guarantee that you are at least 18 years old and have full legal capacity to enter into this contract.
3.4. Responsibility for Age Deception: Accounts identified as belonging to individuals under 18 years old may be suspended or terminated immediately. If a minor deceives this restriction to access the game and make purchases or donations, their parents or legal guardians will be fully and jointly responsible for all actions taken by the minor on the Server, with no right to refunds or reimbursements on the grounds of minority.
4. LICENSE OF USE AND RESTRICTIONS
4.1. The license granted by The Classic Games to the User is conditioned upon the observation and strict compliance with this Agreement and the Conduct Rules. Its purpose is solely for entertainment.
4.2. The Classic Games does not guarantee differentiated treatment for Users who use the Server for online streaming, content creation, or any activity for profit. The User who makes profitable use of the license will be fully responsible for their actions.
5. INTELLECTUAL PROPERTY AND TRANSACTIONS (RMT)
5.1. All content on the Server, including accounts, characters, items, and virtual currencies, as well as logos, trademarks, and the software itself (game client), are the exclusive property of The Classic Games and its respective original developers/licensors. The User acknowledges that the Account is merely the access vehicle and that they do not have ownership rights over these digital assets.
5.2. It is expressly prohibited for the User to: sell, rent, reproduce, adapt, reverse engineer, decompile, or modify the game client files (client modding) without prior authorization.
5.3. The commercialization of game assets (accounts, characters, items, currencies, etc.) for real money or any value external to the Server ecosystem (a practice known as Real Money Trading - RMT) is strictly prohibited. Violation of this clause will result in the immediate termination of your license of use, permanent banning, and confiscation of the involved assets.
6. ADMINISTRATION AUTONOMY AND SERVICE AVAILABILITY
6.1. The Administration has total and discretionary autonomy to interpret rules, analyze conduct, and apply the penalties it deems appropriate, including warnings, suspensions, or permanent bans of accounts and/or IPs, without the right to appeal.
6.2. The Classic Games reserves the right to modify, adjust, or remove any aspects of the Server (economy, systems, events, mechanics) and these Terms at any time, without prior notice.
6.3. The Server may undergo regular, emergency, or update maintenance that temporarily makes it unavailable. The Administration does not guarantee that the service will be uninterrupted or free of technical failures.
6.4. Termination of Activities: The Classic Games reserves the right to cease operations of the Server at any time, by its own deliberation or for reasons of force majeure. In the event of definitive termination (sunset), Users will not be entitled to refunds or financial compensation for the time invested.
7. ACQUISITION POLICY, REFUND AND RIGHT OF WITHDRAWAL (CDC)
7.1. Nature of Acquisition: The Server is free to play (Free-to-Play). The purchases of virtual currencies or special items ("Cash", "VIP", packages") constitute software usage licenses, granted in a limited and revocable manner.
7.2. Right of Withdrawal: Under Article 49 of the Consumer Defense Code (Law No. 8.078/1990), the User has the right of withdrawal within 7 (seven) days from the date of acquisition.
7.3. Loss of Right by Consumption: However, the User expressly agrees that by using, transferring, or consuming virtual currency or items within the game, the service will be considered fully executed. Full execution of the service results in the immediate loss of the right of withdrawal and refund for that specific item or balance.
7.4. Penalties and Refunds: There will be no refund in cases of account banning for rule violations or dissatisfaction with the game. Attempts to chargeback with credit card companies or payment platforms, after consuming items or outside legal guidelines, will result in the immediate and permanent blocking of the User's account.
8. USE OF UNAUTHORIZED THIRD-PARTY SOFTWARE AND EXPLOITATION OF BUGS
8.1. The use of unauthorized third-party software is strictly prohibited, including but not limited to: bots, macros, hacks, cheats, scripts, or any program that automates actions or grants unfair advantages over other players.
8.2. Any attempt to maliciously manipulate the Server's economy (e.g., item duplication or "dupe") is strictly prohibited.
8.3. The discovery of a bug or system flaw must be reported to the Administration privately and immediately. The conscious abuse of any bug for personal or third-party benefit will result in the permanent blocking of all involved accounts.
9. CONDUCT, REPORTS AND INTERACTION WITH ADMINISTRATION
9.1. The reporting system is a tool for maintaining order. False reports or reports with manipulated evidence will be severely punished.
9.2. Ideological Falsehood: Impersonating a member of the Administration (GM, ADM, Staff) to deceive, intimidate, or extort other players is a serious offense, subject to immediate banning.
9.3. Disrespect, harassment, coercion, or attempts to intimidate any member of the Administration on any platform will result in the immediate blocking of all accounts associated with the offender. The Administration's decision regarding a report or punishment is final and sovereign.
10. RESPONSIBILITY FOR INTERACTIONS AND ACCOUNT SECURITY
10.1. All negotiations and agreements made between players are entirely your responsibility. The Administration does not intervene in disputes arising from scams or broken agreements.
10.2. Account Sharing: The usage license is personal and non-transferable. The Classic Games does not approve of account sharing. The User is solely responsible for all actions taken on their account, regardless of who executed them. The Administration will not restore deleted/stolen items or characters due to credential sharing.
11. PRIVACY POLICY AND DATA PROTECTION (LGPD)
11.1. Legal Compliance: The collection, storage, and processing of personal data (such as email, IP, and access logs) are carried out in strict compliance with the General Data Protection Law (Law No. 13.709/2018 - LGPD).
11.2. Collection and Purpose: By using the Server, you consent to the collection of data essential for the operation, support, and security of the game. The data is used exclusively for account administration, security (fraud and hack prevention), rule enforcement, technical support, and continuous improvement of the Server.
11.3. Sharing: Your information will not be sold or shared with third parties, except when required by law, court order, or for payment processing through partner platforms.
11.4. Retention and Deletion: Data will be retained while the account is active. The User may request the deletion of their account, aware that log and IP data may be retained in an anonymized or blocked manner for the time necessary to fulfill legal obligations and safeguard the rights of The Classic Games.
11.5. Official Communications: The email provided during registration will be considered the official communication channel between The Classic Games and the User.
12. DISCLAIMER OF LIABILITY AND INDEMNIFICATION
12.1. The Server is provided "AS IS" and "AS AVAILABLE". The Classic Games does not offer any guarantees that the service will be free of errors or security flaws.
12.2. The Classic Games is not responsible for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Server.
12.3. You agree to indemnify, defend, and hold harmless The Classic Games and its administrators from any claims, losses, or damages resulting from any violation of these Terms by you.
13. THIRD-PARTY LINKS AND FORUMS
13.1. Our services may contain links to other sites (such as forums, Discord, payment sites). The User acknowledges that they will be subject to the Terms of Use and Privacy Policies of those respective sites.
13.2. By using public forums or chats on the Server, the User is aware that the information posted there is public and should exercise caution with the data they share.
14. GENERAL PROVISIONS AND JURISDICTION
14.1. Ignorance of these Terms or the Official Game Rules does not exempt the User from their responsibilities. Connecting to the Server serves as irrevocable proof of your awareness and agreement.
14.2. Any dispute arising from these Terms will be governed by the laws of the Federative Republic of Brazil, with the jurisdiction of the district of São Paulo/SP being elected, with express waiver of any other, no matter how privileged it may be.
